In a divorce action, the court will seek to provide comparably able counsel to both spouses. If one spouse has financial resources which far outweigh the other spouse, financial assistance may be ordered by the wealthier spouse. This is the case even if the less wealthy spouse has sufficient liquid assets to pay for attorney fees, as in the case “Marriage of Hatch” where the less wealthy spouse had “only” two million dollars in liquid assets. This means that a wealthier spouse likely will have to provide financial assistance to the less wealthy spouse if it is requested.
