Who owns the title of equipment?
The title of equipment shall vest in and remain with HKJCICM. Upon completion of the project or termination of the project agreement, HKJCICM reserves the right to remove such equipment. The recipient organisation is required to make available for removal such equipment in which HKJCICM retains title, upon HKJCICM’s request. The recipient organisation will have the right to use the equipment whenever the latter is physically with them. The maintenance of equipment and the risk in them (e.g. loss, damages, liabilities, etc.) will vest in and remain with the recipient organisation upon procurement of the equipment to the point that they are physically removed from the recipient organisation.
