WHO NEEDS AN AFFIRMATIVE ACTION PROGRAM?
As a condition of doing business with the federal government, a written Affirmative Action Program must be developed (and updated annually) if you are a federal government, non-construction contractor OR subcontractor with 50 or more employees, AND • you have a federal contract or subcontract of $50,000 or more; or • you have government bills of lading that total, or will likely total, $50,000 or more in any 12-month period; or • you serve as a depository of government funds in any amount; or • you are a financial institution that is an issuing and paying agent for U.S. savings bonds and savings notes, in any amount. For companies with many locations, each “establishment” with 50 or more employees is required to have a separate Affirmative Action Plan, however there are exceptions.
