All municipal separate storm sewer systems (MS4s) that are located in urbanized areas (as determined by the Census Bureau) must comply with Phase II Stormwater Regulations. Suffolk County must comply with EPA Phase II Regulations. Towns and Villages must also comply with Phase II Regulations as separate government entities. The only towns in Suffolk County that do not have to institute a stormwater management program are East Hampton, Shelter Island, and Southold. However, all construction sites in New York State that disturb greater than or equal to one acre of land are regulated under the small construction activity portion of Phase II.
