Who must complete an I-9 form?
All employees, citizens and non-citizens, hired after November 6, 1986, must complete form I-9 at the time of hire, which is the actual beginning date of employment. The EMPLOYER is responsible for ensuring that Section 1 is timely and properly completed. Preparer/ Translator certification- Must be completed if section 1 is prepared by a person other that the employee. A preparer/translator may be used only when the employee is unable to complete Section 1 on his/her own. Employers are responsible for the completion and retention of I-9 forms for all employees, regardless of citizenship or national origin, hired for employment in the United States. An employee is anyone who is compensated for services or labor by an employer, whether by payment in the form of wages or other remuneration.
