Who May Apply for Mental Health Services?
• An individual of any age may apply for Continuing Care Services from the Department of Mental Health (DMH). An applicant or the applicant’s legally authorized representative (LAR), if any, must sign an application. • An emancipated minor, as defined by Massachusetts law, may apply on his or her own behalf. • A program or facility may sign and submit an application on behalf of an adult only under one of the following circumstances: • The program or facility notifies the applicant that an application is being submitted on his or her behalf, and the applicant does not object. In these circumstances, a mental health professional working for the program or facility must document on the application the date the applicant was notified about submission of the application and the applicant’s response. • The program or facility believes that the applicant is incapable and has filed a petition for guardianship with the court.
