Construction along rivers is very common. In the past there was no regulation prohibiting construction of non conforming buildings. People may maintain buildings that have been built prior to new regulation. Permits are issued on a case by case review. The risk is addressed to the developer at the time of building. Delhaven at the time of construction, for instance, was not within the flood plain but has been added since.
