Who is Responsible or Weed Control on Rights-Of-Way?
The easement holder is responsible for controlling noxious weed infestations along the right of way and introduction on adjoining lands as a result of their use of the right of way. The easement holder may contract with the state’s surface lessee, county weed personnel, or independent contractors for performance of control measures.
