Who is responsible for the oversight and monitoring of the MOT order?
The community services board where the person resides is responsible for monitoring compliance with a mandatory outpatient treatment plan ordered pursuant to 37.2-817. Monitoring activities must include (i) contacting the service providers to determine if the person is complying with the mandatory outpatient treatment order and (ii) notifying the court of a person’s material noncompliance with a mandatory outpatient treatment order. Providers of any services identified in the MOT plan are also required to report any material noncompliance to the community services board monitoring the MOT plan. Monitoring responsibility may also be transferred from one CSB to another pursuant to 37.2-817.J.
