When you bought your house did you have a survey of the property? If so, it will tell you if the fence is on your property or the neighbor’s property. If the fence is on your property then you will be responsible for any repairs. That is, unless the neighbor’s caused that damage. But, if they caused the damage to your fence then you might have to go the route of a lawsuit to get them to fix it. If the fence is on the neighbor’s property then it is theirs to fix. However, if they don’t want to fix it then you can’t do anything about it. There are some more legal in’s and out’s about liability and stuff. If it was damaged in a storm or some weird other way homeowners insurance might cover it. There are a lot of different situations that could affect your fence situation. and BTW, I am also in Texas with experience with fence problems with a neighbor.
