Who is responsible for paying to clean up the contamination?
There are specific procedures under the Environmental Protection Act 1990 to allocate liability and costs for cleaning up contamination at a site. However, if the site is to be developed, the costs are likely to be met by the developer. Otherwise we will try and trace the original polluter who is then liable for the clean-up costs, under the “polluter pays” principle.
