A21 Trustees/Board of Management members have a responsibility to the Charity. Any malpractice is the responsibility of the board of trustees/directors. It is the their duty to act in the best interests of the Charity and the Board of Directors – the Company. It is almost unheard of for a case of negligence to go to Court however all members are expected to act with the best intentions of the Charity/Company/Association as paramount. Trustee Indemnity insurance covers against negligence but not fraud and any risks can be minimised by setting up the organisation correctly from the outset.
