Who is responsible for meeting the legal statutes?
The Board appoints the Purchasing Agent to act on their behalf and it is one of her/his primary responsibilities to ensure that BOCES meets the competitive bidding legislation. This legislation is very precise and if followed correctly will be an aid to both BOCES and prospective vendors. These laws were created to protect BOCES, and its employees, and the suppliers and their employees. BOCES is considered to be a “public agency” using public (taxpayer) funds and thus is subjected to strict controls. These controls, however, should be viewed as judicious protective safeguards.
