Who is responsible for breach when a young person receives a YRO with two or more requirements, none of which are managed by the YOT?
In this scenario, responsibilities will lie with whoever the court designates as the responsible officer. All agencies involved in the young person’s YRO will be aware of the additional requirements through their copy of the court order. It is best practice for these agencies to keep in contact should a need for breach proceedings occur and ensure all other agencies are notified of this. A proposed framework for defining case management, case supervision and enforcement and compliance responsibilities is contained in the YJB’s attendance centre protocol available at http://www.yjb.gov.uk/en-gb/practitioners/CourtsAndOrders/Disposals/AttendanceCentreOrder/. It should be noted that this framework is for guidance only and local practice may differ from this.
