According to the Act, a person who is employed or appointed in the regular or normal course of employment or appointment procedures will not be a participant in the DCRP. It would appear that this broad exclusion precludes the application of the plan to most, if not all, school employees. However, the specifics of who will be eligible for the DCRP will be further clarified through regulations.
