Who is liable for demands, damages, expenses, and losses arising out of the Recipients use for any purpose of Biomaterials, Clinical Data, and Genetic Analysis Data received from the NCGS?
A20. The Recipient is liable. Under the Distribution Agreement the Recipient agrees to hold the United States Government, its contractor and subcontractor that operate the NCGS, Submitters, and other Recipients providing Genetic Analysis Data to the NCGS harmless and to indemnify all such parties for all liabilities, demands, damages, expenses, and losses arising out of the Recipient’s use for any purpose of Biomaterials, Clinical Data, and Genetic Analysis Data received from the NCGS.
