Who is inspecting I-9 files?
• Immigration and Customs Enforcement (ICE) – The largest investigative arm of the Department of Homeland Security. They play the lead role in enforcing I-9 compliance. Investigations by ICE may be the result of a complaint, or may be at ICE’s own initiative. • Department of Labor- Employment and Training Administration and the Employment Standards Administration have the authority to review I-9 forms. • Office of Special Counsel- Created in 1986 under IRCA as an independent federal investigative agency. Responsible for investigating unfair immigration related employment practices. • Social Security Administration- Since July, 2002, the SSA has actively verified a foreign national’s immigration status before issuing a Social Security Number.
