Who is eligible to self-petition under the Violence Against Women Act?
Self-petitions are available to: • Abused spouses married to U.S. citizens or lawful permanent residents (or if divorced within 2 years of filing). These persons may apply for themselves and for their abused or non-abused children, even if the children are not related to the U.S. citizen or lawful permanent resident. • Abused children of U.S. citizens or lawful permanent residents. • Immigrant parent of a child who has been abused by the child’s U.S. citizen or legal permanent resident parent.
