Any employee who has worked in the State of New Jersey and has earned (a) at least $143 per week in the 20 weeks preceding the leave, or (b) more than $7,200 in the 12 months preceding leave, may apply for wage continuation benefits under the FTDL. The employee’s earnings can be from any combination of employers, not just the company for whom he or she is working at the time leave starts. Nor is there a minimum amount of time the employee must work for the particular company before he or she may apply for FTDL (although leave rights for new employees may be severely limited). An employee may not receive payments under the FTDL if he or she has been unemployed for longer than two weeks, or is collecting workers’ compensation or temporary disability payments for their own medical condition.
