Who is eligible for record expungement?
• Those who have never had a prior record sealed or expunged • Those who have never been adjudicated guilty of a prior criminal offense or the current offense they wish to have sealed (received a withheld adjudication, dismissal of the charges, or not guilty after trial • Those whose criminal arrest record does not pertain to an offense on the prohibited offense list; and an indictment or other charging document was never filed in the case, or after an indictment or other charging document was filed, it was dismissed by the State or the Court • You are also eligible for an expungement after your record has been sealed for 10 years.
