Who does the right to rescind apply to?
This European Community rule provides that the right to rescind may only be exercised by consumers or users. This is a natural person who acts for reasons not related to any entrepreneurial, business, amateur or professional activities possibly performed. The right to rescind therefore may not be exercised by a legal person or by natural persons acting for purposes tied to a business activity as broadly indicated above. What does it mean? The right to rescind allows the customer to rescind, that is to unilaterally dissolve the contractual obligation within 10 business days from receiving the goods by returning the asset to the seller, who shall reimburse the user the price of the returned goods.
