Current statutes and regulations do not adequately address check image exchange. Both Reg. CC and the revised (1990) Uniform Commercial Code (UCC) Article 4 briefly mention truncation, electronic check presentment and/or image exchange but leave the provisions of those exchanges to agreement between the parties. Check 21 only applies to Substitute Checks (a legal equivalent of the original check and the Federal Reserve Operating Circular and its Regulation J applies to image exchanges through the Federal Reserve. Additionally, there is no case law and without statutes, regulation or case law to guide the courts in resolving disputes, the outcomes of adjudication are uncertain.
