The Court, or the parties and their legal representatives by agreement. Sometimes the professional monitors will make recommendations to the parties and their legal representatives if the monitor believes the child is not benefitting from the type of visitation/exchange being used. The Court, the parties and their legal representatives are under no obligation to respond in the affirmative to any such suggestion from a monitor in a situation where such input has not been expressly requested by the Court. Ultimately, it is the Court who will decide if there is to be a change in the type of visitation/exchange being utilized.
