Who decides what should be included in the Advanced Information pack on cases where the charging decision is made by the duty prosecutor?

A. It is important that the duty prosecutor indicates what if any material should be copied into the AI pack as this will be used by the police or CPS admin team in producing a proportionate bundle. Without guidance about what constitutes ‘key evidence’ which must be copied and what is ‘non key’ and can be left out, all statements will be unnecessarily copied. This is wasteful of resources. To that end it is important to insert a heading into the MG3 advice ‘content of advanced information’ followed by a list of ‘key’ statements and other ‘key’ evidence to be copied.
