Who carries the responsibility to produce one?
Whenever a building is offered for sale or to let, the seller or landlord is responsible for making an EPC available to potential purchasers or tenants. A tenant wishing to assign his interest should produce an EPC for any potential assignees. The seller or landlord is responsible even if an agent is used. Lease renewals, extensions, compulsory purchase and surrenders do not require an EPC. Depending on the lease and the circumstances, the landlord can sometimes recover the cost of producing an EPC through the service charge. An EPC is also required on the new construction, or occasionally, the modification of a commercial building. Building Control will not be able to sign off practical completion until an EPC has been produced by the owner of the building. The person carrying out the construction is responsible for generating the EPC.
