A person’s residence and domicile, for bankruptcy purposes, is the place where he or she has lived for the majority of 180 days preceding the bankruptcy filing. For example, a person could file bankruptcy in a Texas bankruptcy court 91 days after moving to Texas from a residence in another state. If you file bankruptcy in Texas, however, you can only claim Texas’s asset exemptions if you have resided in Texas for the previous two (2) years. The Texas Bankruptcy Court Districts include the Southern, Western, Northern, and Eastern Divisions.
