Who can bring a claim in a drunk driving accident case?
As a general rule, any injured person has the right to bring a claim against the drunk driver for the injuries they sustain in the accident. In addition, if someone is seriously injured or killed as a result of a drunk driver who was served liquor while visibly intoxicated, the injured person or his or her heirs and next of kin may have a right to bring a claim against the bar or restaurant that served alcohol to the drunk driver.
