Who assesses whether an individual has capacity to make decisions?
Two people are required to complete an assessment of capacity, one of which must always be a physician or psychologist. One option for capacity assessments is makers can name a person they trust to assess their capacity in consultation with a physician or psychologist. The forms that must be completed are in the regulations to the Personal Directives Act. If the maker doesn’t name anyone to assess their capacity, the second option is for two service providers, one of whom must be a physician or psychologist, can assess capacity.
