Which states statutes of limitations applies here? Probably Florida (either four or five years, depending on the type of debt), but it is possible, depending on facts you don’t state here, that another state’s statute of limitaiton will apply. Do I send them a letter to Cease and Desist? You can do that whether the limitation period has run or not. One has nothing to do with the other. If they sue you, to successfully assert the SOL as a defense you have to handle it properly or you will be said to have waivedd that affirmative defense.
