• Section 1(i)(xii) of the FOIP Act sets out the test for whether a local government agency is subject to the FOIP Act. • To determine whether an entity is covered, ask the following questions: • If the answer to all three questions is “yes”, then the entity is subject to the FOIP Act. • EPCOR and ENMAX and their gas or electric subsidiaries are specifically excluded from the scope of the Act.
