Where will the new law on smoking apply?
The law prohibits smoking in certain public places which are “wholly or substantially enclosed”. The law applies to vehicles as well as premises, specifically vehicles used for business purposes. A full list of 22 types of no smoking premises including vehicles are set out in Schedule 1 to the Prohibition of Smoking in Certain Premises (Scotland) Regulations 2006. Exempt premises and vehicles are set out in Schedule 2. The legislation can be viewed at www.clearingtheairscotland.com. Such is the comprehensive nature of the ban with so few exemptions such as residential premises and private vehicles, if you smoke, you are likely to be affected by the ban in all but a few public places.
