Where is it not legal for a cop to sit and pull you over for speeding??
~Sigh~ Why do people keep asking this question. School property is state property……….it is an enhanced penalty to speed in a school zone. Kids could get killed. I really don’t know why you would try to bring this up as some sort of excuse. Anyway, the Police may run radar pretty much from wherever they want (i.e. store parking lots, the median of a road, private property, school drives, etc.) as long as it is safe to do so. Of course if an Officer does want to sit on someones drive he/she would probably want to get permission. I have had citizens tell me (unsolicited) to sit in their driveway and catch speeders. They don’t want their kids to get run over either. If a citizen asks an Officer to leave their property then he/she should leave. If someone gets a ticket from an Officer who was running radar off of someone’s private property then that is between the Officer and the owner of the property. It is not a defense for the speeder who has no expectation of privacy on that prope
