In Pokemon Pearl, you’ll receive HM07 Waterfall in Sunyshore City from Jasmine, a Johto Gym Leader, after you have defeated Volkner: “Go to the north of the city, where you’ll meet Jasmine, a Gym Leader in the Johto Region. She’ll give you HM07 – Waterfall.” – PokeDream.com And yes, you need to beat the eighth Gym Leader (Volkner, who specializes in Electric-Type Pokemon, of Sunyshore City) and receive the Beacon Badge in order to use the HM outside of battle, AKA going up or down waterfalls.
