Basically, under typical circumstances, the Officer had no right to conduct a search merely beacause she did not possess a valid License. That doesn’t mean that factual circumstance might not indictate otherwise, e.g., she made a furtive move to her body immediately prior to the stop that could be interpreted by a reasonable Police Officer as trying to hide something. Even if probable cause for the search existed, there may be a cause of action if his search was sexual rather than probative in nature. For better or worse, this is often a matter of interpretation. If she filed a formal complaint, she should have a response within a reasonable time – probably no more than 45 days. At that time, or before, if she feels the Officer was acting in a sexual and unlawful manner, she should probably speak with an attorney who specializes in police misconduct.
