When will a High Risk Enforcement Action 2 (Persistent Noncompliance) be escalated to High Risk Enforcement Action 3?
Answer 3-5: A High Risk Enforcement Action 2 ( Persistent noncompliance) will be considered for escalation when the licensee does not comply with the requirements in Table 2. ERCB Enforcement of High Risk Noncompliance of Directive 019 to the satisfaction of the ERCB group and if an additional high risk noncompliance occurs within the same compliance category during the specified time period from the date the action plan was accepted. Contact by senior ERCB staff is required prior to the escalation of enforcement action.
