When should HCWs be terminated based on violations of protective services and abuse laws?
A. Keep in mind that clients can terminate a HCW’s employment with them at anytime and for any reason, regardless of the outcome of an APS investigation. Unless there is imminent danger, it is advisable to wait until the APS investigation is concluded and the violation has been substantiated. It is important to communicate with the APS investigator and ask whether the investigation can be expedited if a HCW is involved. Violation of protective service and abuse laws are specific to OAR chapter 411, division 020 (Seniors & People with Disabilities).
