When may a man resume the use of a premarriage surname?
Although not as typical, some men change their surnames when they get married. If so, at the time of divorce, a man may request the use of his premarriage surname in the Divorce Complaint, in the Answer and Counterclaim he files in response to the Complaint. If so, the Absolute Divorce Judgment will contain a provision permitting the man to resume the use of his premarriage surname.If the man does not seek to resume the use of his premarriage surname as a part of the Absolute Divorce proceeding, later on, he may make a written request to the clerk of court of the county in which he resides or in which the Absolute Divorce Judgment was entered and seek permission to resume the use of his premarriage surname.
