• A permit must be obtained from the Department whenever: • The design flow is 1,000 gallons per day or greater; • The wastewater is not normal domestic wastewater; • The system may endanger human health or cause pollution; or • The system cannot meet all the provisions for design, setback distances and reserve area prescribed in Title 124, including: • Soil percolation rates slower than 60 minutes per inch; and • Less than 4-foot separation from the bottom of the trench to groundwater. • The plans, reports and other technical documents submitted as part of the application must be prepared and properly stamped by a Professional Engineer licensed in the state of Nebraska. • Note: If a permit is required, a construction permit must be obtained prior to commencing any construction of the onsite wastewater treatment system.
