Per LOA 01-013, Subpart B, NJASAP becomes the bargaining agent for NJI pilots on Nov. 21, 2010, or upon remission of the Final Integration Notice, whichever occurs earlier. The courts have taken a very black-or-white approach to the issue: Not only does NJASAP become the bargaining agent for NJI pilots on that date, but also NJASAP assumes a Duty of Fair Representation for NJI pilots on Nov. 21, 2010.
