When does NAFTA apply to U.S. and Mexican citizens?
NAFTA applies to U.S. and Mexican citizens who are “business persons.” The term “business persons” includes “individuals engaged in the trade of goods or services or in investment activities.” There are four broad categories of “business persons” under NAFTA: business visitors, intra-company transferees, professionals and traders/investors. Furthermore, NAFTA sets out seven subcategories within which a person must fall in order to be able to acquire business visitor status: research and design; growth; manufacture and production; marketing; sales; distribution, after-sales services and general service.
