When can a supplier refuse to supply petroleum products?
The Oilcode does not allow a wholesale supplier to ‘unreasonably refuse’ to supply a declared petroleum product by wholesale to a customer. The Oilcode lists three specific circumstances in which refusal to supply will be reasonable. Specifically, these are when the wholesale supplier: • does not have sufficient supply • has a reasonable belief that the customer is unable to pay for the supply • has a reasonable belief that the customer is unable to receive or transport the supply in compliance with all occupational health and safety requirements that are applicable.
