I wasn’t aware until recently that Home Health Aides are not covered under the basic overtime (i.e. time and half) regulations most hourly wage workers are covered by. Despite being a major source of employment at the moment and providing an increasingly necessary service these workers get a dollar more if they are lucky for every overtime hour they work. A few years back a Home Health Aide by the name of Evelyn Coke sued the labor department and the case reached the Supreme Court in 2007 but the court ruled 9-0 in favor of keeping them uncovered. The Supreme Court argued that some clause originally intended for domestic workers and maids did not allow HHA’s to be covered. I don’t understand how it is just not to properly compensate these people.
