in some states you only have to have the consent of one party to record a conversation in others you most have both but it was most likely illegal and legal action can be taken, the government records all phone calls and other data and do not need a warrant to listen in to conversations now days

Depends on the state. Each state has its own laws on recording and video taping people without their consent…there are like 5 states that require notification.

It is illegal to record a telephone conversation without notifying the other person. And that notification has to be recorded also.
