About 35 years ago many states (not California unfortunately) became officially aware of the fact that professional licensing boards and the professional associations who got cozy with them were sometimes using examinations like the Oral exam in California, to manipulate the market for their industries. It’s very simple: You throw up a barrier to licensure, like an Oral exam that only 40% can pass, reducing the numbers that gain entrance to the field. This “thins” the field, and it’s associated competition. You have a tool to manipulate competition. Of course it is the consumer and the licensure candidate who suffers here, and this isn’t what the test is supposed to be doing. So these states created a kind of watch-dog legislative organization called a “Sunset Review Committee” to monitor this sort of activity.
