As both pilots already have traffic, a failure at this time would actually result in pilots having better situational awareness than if the failure occurred when they were under full ATC control. If ATC radio fails, both pilots are on the same frequency and can communicate this way. If a transponder or the radar fails, the usual radar failure procedures for IFR flight would apply as per the ERSA In Flight Emergency Response (pink) pages.
