What would be the legal repercussions of naming a competing brand of athletic clothing to lululemon as “mumumelon”?
I’m not an attorney, but assuming this hit lululemon’s radar, I’d expect their legal team to send a cease and desist claiming the name infringes on their TM. Names are TMed based on pronunciation, not spelling, and this is a clear case of the competitor trying to sound like lululemon. It could also result in a lawsuit, where lululemon asserts that they’ve suffered as a result of the competitor’s infringement (i.e., people accidentally bought the “fake” brand, so lulu lost money).
