What will happen if employers do not check if staff are ISA registered?
There will be tough penalties for those who fail in their responsibility to carry out the necessary checks or recruit people who are not registered with the ISA and are required to do so; or who recruit people who are barred from working with children and/or vulnerable adults. Employers who knowingly permit a barred individual to engage in regulated activity will face a maximum penalty of up to six months in prison, plus a fine. It will be a criminal offence for a barred individual to seek a job or to volunteer in a regulated activity, if they do so, they face a sentence of up to five years imprisonment, plus a fine.
