LXP will “own” carrier performance and will be tracking all incidents. Inevitably claims will arise, and we anticipate the process working very much like it does today. Since LXP never pays for any product in the supply chain, we are working with McDonald´s legal resources to determine the best method for claims management. Initially, LXP will establish a $500 claim minimum, and typical OS&D variances will be handled between the manufacturer and the distribution centers. Carrier liability will be limited to total loss incidents involving gross negligence, water damage, infestation, or temperature issues.
