The Court held a Fairness Hearing at 9:00 a.m., on July 19, 2010, at the United States District Court for the Western District of Kentucky, Gene Snyder U.S. Courthouse, 601 West Broadway, Louisville, Kentucky. At the Fairness Hearing, the Court heard arguments from the parties as to why the proposed Settlement is fair, reasonable, and adequate, as well as arguments from objectors to the Settlement. On August 23, 2010, the Court issued an Order granting final approval of the Settlement. In a Memorandum Opinion, the Court determined that the Settlement Agreement entered into by the parties is fair, reasonable and adequate.
