What was the result of the Appeal Court hearing on 10 and 11 March 2010?
A. On 10 June 2010 three Appeal Court judges handed down judgement dismissing an appeal by local resident Mrs Vivienne Morge against the previous judgement of His Honour Judge Bidder QC in November 2009. This supports the original decision to uphold Hampshire County Council’s granting of planning permission for South East Hampshire Bus Rapid Transit Phase 1 – Fareham to Gosport on 31 July 2009. The injunction that had been in place since the appellant lodged her case with the Court of Appeal in early December 2009 has now been lifted with immediate effect, which means that there are no legal reasons relating to planning why construction cannot now commence. The issue of two outstanding Town/Village Green applications remains, however, and these are following due process through non-statutory public inquiry and subsequent decision by the local registration authority.
